1. Introduction

1.1. Major changes to UK data privacy law came into effect on 25 May 2018. The General Data Protection Regulation (GDPR) replaced the Data Protection Act with the intention of giving individuals more control over how their personal information is gathered, stored and used by organisations. GDPR requires that organisations gain the consent of individuals regarding the use of their personal information and ensure that it is better protected. GDPR also requires organisations to supply individuals with details of any personal information they hold about them within one month of the individual requesting it.

1.2. Designs takes GDPR seriously and is committed to protecting your personal information. Our Privacy Policy gives you detailed information on when and why we collect your personal information, how we use it and keep it secure. The Policy also sets out your right to request that we delete, update and provide you with access to your personal information.

3. How we collect your personal information and use it

3.1. We only collect the personal information necessary from you for us to communicate or conduct normal transactions with you as a seller or purchaser of fashion items through Designs.

3.2. The Designs website www.designsnw3.co.uk is for our marketing and client information purposes only. We do not collect or use information on those who visit the site. Our website contains no links to third party websites or services.

3.3. If you choose to sell your nearly new fashion items through Designs we collect the following information when first setting up your account: name, postal address, contact phone number/s and email address. If we agree to pay you the proceeds of your sales by BACS we also collect your bank account name, sort code and account number. If we do not pay you through BACS we do not need to collect your bank details, as we then pay small sums (up to £50) in cash and larger sums by cheque for collection instore at Designs.

3.4. If you purchase nearly new fashion items from Designs we only collect your information if you choose to accept our invitation to join our loyalty scheme by becoming a Privilege Card holder. This will include your name, postal address, contact phone number/s and email address. As Privilege Card benefits include email alerts announcing the arrival at Designs of items by your favourite designers and giving you advance notice of special sales events, you will be given the option to opt in or out of our Privilege emails (you will be asked to confirm or update your preference next time you make a purchase and you can change your preference at any time by emailing dominique@designsnw3.co.uk). We do not collect information from purchasers who do not hold a Privilege Card.

3.5. If you sell and purchase through Designs we collect your information as shown in both 3.3 and 3.4 above.

3.6. Where we have collected your contact details we will only send you emails that relate to your interest in Designs as a seller, purchaser or both and only when you have opted to receive them.

3.7. Existing clients, sellers and purchasers who became Privilege Card holders prior to 25 May 2018 are asked to email dominique@designsnw3.co.uk to reconfirm whether they wish to continue or begin receiving emails from Designs from this date or wish to opt out from receiving these. If we do not receive your confirmation we will assume you have opted out and will no longer send you emails until you confirm otherwise.

3.8. New clients, sellers and purchasers who become Privilege Card holders after 25 May 2018 will when initially supplying their information be asked to confirm whether they wish to receive emails from Designs or opt out from receiving these.

3.9. You can opt in or out of receiving emails from Designs at any time by emailing dominique@designsnw3.co.uk.

3.10. We will not contact you about any non-Designs related issues.

4. Financial transactions and information

4.1. If you sell through Designs we will never email you requesting you to provide or confirm by email any personal information regarding your bank details. Such a request will only be made confidentially in person instore by the manager or an assistant manager if you require us to set up your Designs account to make payments to you by BACS.

4.2. If you buy through designs each sale is on an individual transactional basis and we do not keep records of your bank or credit card details.

5. How long do we keep your personal information for?
Whether you sell through Designs or are a purchaser holding a Designs Privilege Card, we only retain information for as long as it is required. You can request us to delete your information at any time. We will automatically delete your information when you close your account or when you have ceased being an active client for a continuous period of 48 months.

6. Confidentiality and security of your personal information

6.1. We are committed to keeping the personal information you provide to us secure and will take reasonable precautions to protect your personal information from loss, misuse or alteration.

6.2. All members of our staff have signed a confidentiality agreement barring them from disclosing your information to any third party.

6.3. We will never pass any of your information on to a third party unless you expressly request us to do so in writing by letter. For your security, we will not accept or action such a request made by telephone or email or any other means or from a third party.

7. Your right to access your information
You have the right to know what personal information we hold about you and can at any time request us to confirm the details. For your security, your request should be made in writing by letter or by completing our personal information request form, which is available instore or by email from dominique@designsnw3.co.uk. We have an obligation to respond to any such request within one month without charge, but a charge may be made for any additional copies if you request these.

8. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect any changes in how we use personal information or to comply with changes to relevant legal or regulatory requirements. We will notify you by email of any significant changes, but our current Privacy Policy can be reviewed here on our website at any time.
